Who Regulates Gambling in New Jersey?

New Jersey Gambling Laws Compared to Neighboring States

Delaware also legalized online casinos in 2013. However, there is only one regulated online casino in the First State, and it only offers a limited selection of games. First, it comes down to economics. New Jersey wanted online casinos to give its ailing gaming industry an economic boost and, after a slowish start, it’s largely been a success story.

The Las Vegas casino industry has never faced the economic difficulties that Atlantic City did beginning in the late 2000s, so while you can characterize Atlantic City as the “Vegas of the East Coast,” they’re really very different economically and politically.

In Atlantic City, you have nine casinos, and that’s it. In Nevada, you have hundreds. The Nevada legislature is required by law to “foster the stability and success of gaming” and they’ve never quite been sold on online gaming.

There may be hundreds of casinos in Nevada but there are also a relatively small number of really big players, such as MGM Resorts, Caesars Entertainment, and Wynn Resorts. It’s likely that these big names would dominate a Nevada online casino market, arguably to the detriment of smaller land-based casinos.

How much competition does New Jersey face from other regulated markets in the area, such as Pennsylvania or Delaware?

New Jersey faces huge competition, from Pennsylvania in particular. For the whole of the 1980s, Atlantic City had a monopoly on casino gaming across the entire Eastern Seaboard and benefitted from being the closest gambling destination to the New York metropolitan area, one of the most populous areas in the world.

Atlantic City’s gaming revenues peaked in 2006. It’s no coincidence that was also the year that the first casinos were being built in Pennsylvania, and many existing racetracks received licenses to host slots. Now you have a cluster of casinos in Philadelphia that suck up the footfall from New York.

The increase in competition and the economic downturn of the late 2000s hit Atlantic City hard. In 2014, four of Atlantic City’s casinos closed. That was basically one third of the land-based industry.

Now they’re looking to bring casinos to downstate New York, which could cost Atlantic City 20% to 30% of its casino revenues. That could lead to fresh closures.
